Lawyers and trustees of an estate have a fiduciary duty. This is a legal duty that requires actions made in the best interest of beneficiaries and the executor of the trust. However, when this is breached and trust theft occurs, a trust accounting is required. This is a full financial accounting of a trust. In some cases, disputes may arise, requiring litigation.

Trust Accounting Litigation
Sometimes the beneficiary of a trust may dispute the administration of a trust. When this occurs, the beneficiary has the right to a detailed trust accounting. All funds and monies will be examined. Some cases require court intervention, especially when a trustee does not cooperate. For example: a trust is missing $100,000 in funds. A trust accounting is ordered. The trustee can be compelled by the court to produce the missing funds.
If executor theft or trustee theft occurs, the court can award triple damages. Under Connecticut General Statute 52-564, this is known as "treble damages for theft." If you suspect mismanagement of trust funds or theft, seek help from an attorney immediately.
